Privacy Notice for California Residents

Version 1.0 — Effective January 1, 2025

Introduction

This California Privacy Notice ("Notice") supplements the LegalEdge Innovators, Inc. Privacy Policy and applies solely to visitors, users, customers, and others who reside in the State of California ("consumers" or "you"). We adopt this Notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the "CCPA"), and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this Notice.

This Notice describes: (1) the categories of personal information we collect about California residents; (2) the sources from which we collect personal information; (3) the business or commercial purposes for which we collect, use, sell, or share personal information; (4) the categories of third parties to whom we disclose personal information; (5) your rights under the CCPA; and (6) how you can exercise those rights.

Scope: This Notice applies to personal information we collect on or through our website, applications, and other services (collectively, the "Online Services"), as well as through other means such as information collected offline, in person, and over the telephone. This Notice does not apply to personal information we collect from our employees and job applicants in their capacity as employees and job applicants (which is covered by a separate Employee Privacy Notice). It also does not apply to personal information we process solely as a service provider on behalf of our business customers.

Information We Collect

We have collected the following categories of personal information from California consumers within the last twelve (12) months:

Category A: Identifiers

Examples: Real name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, or other similar identifiers.

Category B: Personal Information (Cal. Civ. Code § 1798.80(e))

Examples: Name, signature, address, telephone number, bank account number, credit card number, debit card number, or any other financial information.

Category C: Protected Classification Characteristics

Examples: Age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex, sexual orientation, veteran or military status, genetic information.

Collected: YES (limited to information provided in legal documents)

Category D: Commercial Information

Examples: Records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

Collected: YES

Category E: Biometric Information

Examples: Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier.

Collected: NO

Category F: Internet or Network Activity

Examples: Browsing history, search history, information on a consumer's interaction with a website, application, or advertisement.

Category G: Geolocation Data

Examples: Physical location or movements (general location inferred from IP address).

Category H: Sensory Data

Examples: Audio, electronic, visual, thermal, olfactory, or similar information.

Collected: YES (call recordings for quality assurance)

Category I: Professional or Employment Information

Examples: Current or past job history or performance evaluations.

Collected: YES (limited to information provided for legal document construction)

Category J: Education Information

Examples: Non-public education information (per the Family Educational Rights and Privacy Act).

Collected: NO

Category K: Inferences

Examples: Inferences drawn from any of the information identified above to create a profile about a consumer reflecting preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Category L: Sensitive Personal Information

Examples: Social Security number, driver's license number, passport number, account log-in credentials, financial account information, precise geolocation, racial or ethnic origin, religious beliefs, contents of mail/email/text messages, genetic data, biometric data, health information, sex life or sexual orientation information.

Collected: YES (account credentials, financial account info, and information provided in legal documents)

Personal information does not include: Publicly available information from government records; deidentified or aggregated consumer information; or information excluded from the CCPA's scope, such as health or medical information covered by HIPAA or the CMIA, and personal information covered by certain sector-specific privacy laws including the GLBA and FCRA.

Sources of Personal Information

We obtain the categories of personal information listed above from the following categories of sources:

Directly from you: For example, from forms you complete, information you provide when registering for our services, ordering products, or contacting customer support; information you input into our platform for legal document construction; and information you provide when participating in surveys or promotions.

Indirectly from you: For example, from observing your actions on our Online Services, including browsing patterns, feature usage, and clickstream data.

From our customers: Our customers (attorneys and legal professionals) may provide information about third parties, such as counterparties to legal documents, in order to use our services for legal document construction.

From third parties: Including marketing partners, data analytics providers, advertising networks, and social media platforms when you interact with our content.

Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following business or commercial purposes:

To provide our services: To fulfill or meet the reason you provided the information, including generating legal plans, constructing legal documents, processing transactions, and providing customer support.

To communicate with you: To respond to your inquiries, send you information about your account or our relationship, provide customer support, and send promotional communications (with your consent where required).

To improve our services: To understand how our services are being used, to develop new products and features, and to conduct research and analysis.

For security and fraud prevention: To detect, investigate, and prevent security incidents and fraudulent or illegal activity, and to protect the rights and property of LegalEdge Innovators and others.

For advertising and marketing: To deliver targeted advertising and measure the effectiveness of our marketing campaigns.

To comply with legal obligations: To comply with applicable laws, regulations, legal processes, or enforceable governmental requests.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Disclosure of Personal Information

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, we have disclosed the following categories of personal information for a business purpose:

"Sale" and "Sharing" of Personal Information

Sale of Personal Information

The CCPA defines "sale" broadly to include disclosing or making available personal information to a third party in exchange for monetary or other valuable consideration. We do not sell personal information in the traditional sense (i.e., for money). However, depending on how you use our services, we may disclose the following categories of information in ways that could be considered a "sale" under the CCPA's broad definition: identifiers (such as IP address, device identifiers, and cookies) and internet or network activity information.

These disclosures occur when we allow third-party advertising partners to collect information through cookies and similar technologies on our Online Services for purposes of delivering targeted advertising.

Sharing of Personal Information

The CCPA defines "sharing" as disclosing personal information to a third party for cross-context behavioral advertising purposes. We may "share" identifiers (such as IP address, device identifiers, and cookies) and internet or network activity information with advertising platforms and advertising networks to provide more relevant and tailored advertising to you regarding our services.

Opting Out

California residents have the right to opt out of the "sale" or "sharing" of their personal information. To opt out, you may:

  • Submit a request to privacy@legaledgeinnovators.com
  • Click the "Do Not Sell or Share My Personal Information" link on our website
  • Use browser-based Global Privacy Control signals, which we honor

We do not knowingly sell or share the personal information of consumers under 16 years of age.

Sensitive Personal Information

We collect the following categories of sensitive personal information:

  • Account log-in credentials (username and password)
  • Financial account information (for payment processing)
  • Information you provide in legal documents (which may include Social Security numbers, driver's license numbers, or other sensitive data depending on the document type)

We use sensitive personal information only for the following purposes: (1) to perform services you request; (2) to ensure security and integrity; (3) for short-term transient use; (4) to perform services on our behalf; (5) to verify or maintain quality or safety; and (6) for purposes that do not involve inferring characteristics about you.

We do not use or disclose sensitive personal information for purposes other than those permitted under the CCPA. Therefore, we do not offer a "Limit the Use of My Sensitive Personal Information" option because such limitation is not applicable to our processing activities.

Retention of Personal Information

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. The retention period may vary depending on the context of the processing and our legal obligations. Factors we consider when determining retention periods include: the nature and sensitivity of the data; the purposes for which we process the data; applicable legal requirements; and the statute of limitations for potential legal claims.

Generally, we retain personal information as follows: account information is retained for the duration of the account relationship plus a reasonable period thereafter; transaction records are retained for seven (7) years; and marketing data is retained until you opt out or request deletion.

Your Rights Under the CCPA

If you are a California resident, you have the following rights under the CCPA:

Right to Know

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (or longer upon request, if we are able to do so without disproportionate effort). Once we receive and verify your request, we will disclose to you:

  • The categories of personal information we collected about you
  • The categories of sources for the personal information we collected about you
  • Our business or commercial purpose for collecting, selling, or sharing that personal information
  • The categories of third parties with whom we share that personal information
  • The specific pieces of personal information we collected about you
  • If we sold or shared your personal information, lists of the categories sold or shared and the categories of third party recipients

Right to Delete

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and verify your request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service providers to: complete a transaction; detect security incidents; exercise free speech or other legal rights; comply with legal obligations; or use the information internally in ways reasonably aligned with your expectations.

Right to Correct

You have the right to request that we correct inaccurate personal information we maintain about you, taking into account the nature of the personal information and the purposes of processing.

Right to Opt Out of Sale or Sharing

You have the right to direct us not to sell or share your personal information. To exercise this right, please see the "Opting Out" section above.

Right to Limit Use of Sensitive Personal Information

You have the right to limit our use of sensitive personal information to uses that are necessary to perform services you request or that are otherwise permitted by law. As noted above, we only use sensitive personal information for permitted purposes, so this right is not applicable to our processing activities.

Right to Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not: deny you goods or services; charge you different prices or rates for goods or services; provide you a different level or quality of goods or services; or suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Exercising Your Rights

Submitting a Request

To exercise the rights described above, please submit a verifiable consumer request to us by:

  • Emailing us at privacy@legaledgeinnovators.com
  • Calling us toll-free at (312) 555-0100
  • Submitting a request through our online Consumer Rights Request Form on our website

Only you, or a person or business entity that you authorize to act on your behalf (an "authorized agent"), may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

Verification

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. To verify your identity, we may ask you to provide:

  • Information that matches information we already have on file for you (e.g., name, email address, account information)
  • A signed declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request
  • Additional verification documentation if the request involves sensitive personal information

Authorized Agents

You may designate an authorized agent to make a request on your behalf. If you use an authorized agent, we may require:

  • Written permission signed by you authorizing the agent to submit the request
  • Proof that the agent is registered with the California Secretary of State (if applicable)
  • Direct verification of your identity with us

Response Timing

We will respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding our receipt of your request (unless you request a longer period and we can fulfill that request without disproportionate effort). If we cannot comply with a request, our response will explain the reasons we cannot comply.

Data We Process as a Service Provider

In many cases, we process personal information on behalf of our business customers (e.g., law firms and legal departments) who use our platform for legal document construction. In these instances, we act as a "service provider" under the CCPA. For such data, our customer is the "business" responsible for the personal information and is responsible for determining how to respond to consumer requests.

If you wish to exercise your CCPA rights with respect to personal information that we process on behalf of one of our customers, please contact the relevant customer directly. If you submit a rights request directly to us that pertains to information we process on behalf of a customer, we will forward your request to that customer.

California "Shine the Light" Law

California Civil Code Section 1798.83 permits California residents who are our customers to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes. If you have questions about this policy, please contact us at privacy@legaledgeinnovators.com.

Financial Incentives

We do not offer financial incentives, price differences, or service differences to consumers in exchange for the retention or sale of personal information. If we offer any such programs in the future, we will provide notice and obtain your opt-in consent as required by the CCPA.

Changes to This Notice

We reserve the right to amend this Notice at our discretion and at any time. When we make material changes to this Notice, we will post the updated Notice on our website and update the Notice's effective date. Your continued use of our Online Services after any such change constitutes your acceptance of the new Notice.
